Attestation of Power of Attorney / Will

 

I.  Power of Attorney (POA) :

 

Requirements : 

  • Duly filled in Miscellaneous application form (Click here).
  • Attach your original passport and a copy of its main pages.
  • If you are an Indian passport holder attach original and a copy of your PR card/Work or Study permit. Please note that in case your PR card is issued or reissued after 01.01.2015, original and a copy of landing paper is also required.
  • Attach original POA which needs to be attested alongwith its copy (Please Note that the POA must be attested/notarized as per note # below).
  • Presence of applicant is required for execution of "Power of Attorney". (Please note that presence of two witnesses is required for "Will").
  • If you are applying by mail - read the note at the end of this page for eligibility and enclose return prepaid envelope with your address and send the complete set of documents to :

  • Fee :
    • For Power of Attorney regarding property matters : Attach bank draft of C$ 35 drawn in favor of "Consulate General of India". Please Note that C$ 35 is for one seal & signature, if you need it on more pages fee applicable will be C$ 35 x number of pages on which you need seal and signature.
    • For other civil documents : Attach bank draft of C$ 19 drawn in favor of "Consulate General of India". It is clarified that the fee of C$ 19 is for one seal & signature, if you need it on more pages fee applicable will be C$ 19 x number of pages on which you need seal and signature. Example: If you need seal and signature on two pages fee applicable would be: C$ 19 x 2 = C$ 38. (Please Note that Cash, personal cheques or debit/credit cards are not accepted).

 

II. Will :

  • Presence of applicant is required for execution of "Will". Please note that presence of two witnesses is required for "Will". However, applicant has to sign the "Will" in front of Consular Officer, must ensure that name, address and signature of witness on the last page of the document is obtained before submitting at the Consulate for execution of Will.
  • Will for Canadian Nationals : Will has to be notarized and authenticated by the Ministry of Government Services, Ontario (address: 222 Jarvis Street, Main Floor, Toronto, M7A 0B6) or the concerned Provincial authorities before submitting it to the Consulate for attestation. The consulate will attest, seal and signature the concerned Provisional authorities on the page attached by them with the Will.
  • Fee : 
    • For 'Will' regarding property matters : C$ 35 per seal and signature. 
    • For other 'Will' documents :  Attach bank draft of C$ 35 drawn in favor of "Consulate General of India”. It is clarified that the fee of C$ 35 is for one seal & signature, if you need it on more pages fee applicable will be C$ 35 x number of pages on which you need seal and signature. Please Note that cash, personal cheques or debit/credit cards are not accepted. 

 

 

Processing Time :

In person :  Submission time is 0930-1230 hours.

                  Same day (delivery of attested documents between 1500-1600 hours).

By mail : 3 (three) business days excluding the time taken in mail.

 

 

 

# Please Note : 

  • Attestation for Canadian Nationals : (Mail/ Canadian/ Canadian or citizen of any other country) POA/Will has to be notarized and authenticated by the Ministry of Government Services, Ontario (address: 222 Jarvis Street, Main Floor, Toronto, M7A 0B6) or the concerned Provincial authorities before submitting it to the Consulate for attestation. The consulate will attest the seal and signature of the concerened Provincial authorities on the page attached by them with the POA.  
  • Apply in Person (For Indian Nationals) : If you are an Indian national, and residing in GTA apply in person at the Consulate. You need not to notarize the Power of Attorney. However, you have to sign the Power of Attorney(/Will document) in front of Consular Officer, you must ensure that name, address and signature of witness on the last page of POA is obtained before submitting at the Consulate for execution of POA, the witness need not to come at the Consulate.
  • Apply by Mail : If you are residing in area outside GTA, and you intend to apply by mail. In this case POA has to notarized and authenticated by the Ministry of Government services, Ontario/ concerned Provincial authorities before submitting it to the consulate for attestation.
